The sole question presented in this case is whether the right of a tort-feasor to contribution from his joint tortfeasor should be asserted in assumpsit or in trespass. The complaint alleges that the parents of defendant brought an action against plaintiff to recover the damages to their motor vehicle resulting from a collision which occurred when the vehicle, driven by defendant, Edward Beltzhoover, *2collided with a motor vehicle owned and operated by-plaintiff.
