The defendant was tried by the court without a jury for criminal contempt of a Grand Jury in the first degree (Penal Law, § 215.51), on 7 of 8 original counts of the indictment. Each of the seven counts charges refusal to answer a specific question posed to the defendant by an Assistant District Attorney, after having been advised that he received immunity from prosecution, by operation of law, and after having been ordered by a Supreme Court Justice to answer legal and proper questions.
