OPINION

SUHRHEINRICH, Circuit Judge.

Finding the petitioner’s claims of prose-cutorial misconduct and ineffective assistance of counsel meritorious, the district court conditionally granted a writ of habe-as corpus to Petitioner Charles L. Lorraine. Respondent Ralph Coyle appeals. Por the reasons set forth below, we REVERSE.
