Defendant appeals a judgment of conviction for murder, challenging only the sentence imposed. We affirm.

The relevant facts are not in dispute. Defendant committed the crime underlying the conviction in 1997. He was convicted of murder in violation of ORS 163.115(l)(b) and was sentenced to “imprisonment for life” with a minimum sentence of 300 months, pursuant to ORS 163.115(5).

Meanwhile, this court issued its opinion in State v. McLain, 158 Or App 419, 974 P2d 727 (1999), holding that the “imprisonment for life” sentence required by ORS 163.115(5) is unconstitutionally disproportionate. We…
