Appeal from Ringgold District Court. — HoN. R. L. Paeeish, Judge. Dependant was indicted, tried, and convicted of tbe crime of incest, and from tbe judgment against bim appeals.

On April 24, 1902, tbe grand jury of Ringgold county for the April term of tbe district court beld therein returned two indictments against tbe defendant; one for tbe crime of rape, and tbe other for incest. In each defendant was charged with having bad intercourse with one Gertie Blaekmore, a,stepdaughter, who was under tbe age of *302fifteen years. Tbe charge of rape was first tried to a jury, resulting in a verdict of not guilty. Thereupon defendant was placed upon trial for incest.
