The information in this case is founded upon a statute of this state, (Stat., 1854, p. 812,) which makes it a crime to break and enter, in the night-season, the store, shop, or warehouse of another, wherein goods, wares or merchandise are deposited, with intent to commit theft, or any crime punishable by imprisonment in the Connecticut state prison. The accused is charged with breaking, with this criminal purpose, into a certain banking-house, farther described as the store, shop and warehouse of the president, directors and company of the Windham Bank.
