This suit was instituted in the court below, by the State of Texas, acting through her attorney-general, against Robert Mills and John W. Jockusch, residents of the city and *300county of Galveston,, and David G. Mills, a resident of the county of Brazoria.
The petition, or information, represented that the said defendants were partners in-business, associated under the name, firm, and style of R. & D. G. Mills.
