Miller, Judge:

The charter of the city of Bluefield as amended by chapter 3 of the acts of the legislature of 1905, repealing all acts and provisions inconsistent therewith, but not taking away any powers of the city, the council, or any of its officers, conferred by general law, except so far as the same may be inconsistent with the powers thereby conferred, by section 49 thereof provides, among other things, that “said council shall have authority to prohibit the doing of any regular business on the Sabbath day except works of necessity, and may impose reasonable fines and penalties for the…
