In this action, the appellant sued the appellees, to enforce the specific performance of an alleged contract or agreement between the appellant and one Jones Howard, in his lifetime, who had died intestate before the suit was commenced. The appellant and the appellees, except James M. Douthitt, wmre the only heirs at law of said Jones Howard, deceased, and the said Douthitt was the administrator of said decedent’s-estate.
