Appellant and a codefendant, Raymond Potts, were indicted for the receipt and concealment of heroin after unlawful importation thereof, in violation of the provisions of Section 174, Title 21 United State Code Annotated. Section 174 provides for imprisonment of not less than five or more than twenty years for the first violation and for imprisonment of not less than ten or more than forty years for a second or subsequent offense as determined under Section 7237 (c) of the Internal Revenue Code of 1954, 26 U.S.C. § 7237(c).
