Plaintiff began suit in tbe circuit court of Wayne county to recover for overtime work performed between April 30, 1930, and October 5, 1932. Tbe jury returned a verdict in favor of plaintiff, but at a later time tbe trial court entered judgment for defendant non obstante veredicto on the ground that tbe action was prematurely brought before a demand for payment bad been made upon the defendant corporation.
