This case concerns the enforceability of an insurance-coverage exclusion for incorrectly performed work in a commercial-general-liability (CGL) policy issued to a construction contractor. The plaintiff-insurer, Employers Mutual Casualty Company (EMCC or plaintiff), appeals from a Superior Court judgment in favor of the defendant-contractor, Horacio Pires d.b.a. Horacio Pires Painting and Remodeling (Pires or defendant).
