delivered the opinion of the court.
On June 22, 1944 Anton Korch, while driving his automobile, injured the plaintiff, Joseph Doody. Korch was covered by a casualty insurance policy issued by defendant, and the day following the accident he went to the office of the insurance company, reported the accident and gave a statement. Some time in August he received a letter from Doody’s attorney, which he personally delivered to the claim department of the insurance company.
