MEMORANDUM RULING
HICKS, District Judge.
This matter is before the Court on Defendant Circle K Stores, Inc.’s (“Circle K”) Motion for Summary Judgment (Doc. 15). Circle K moved for summary judgment on Plaintiffs Chester Marvin Ports and Dorothy D. Ports (hereinafter sometimes collectively referred to as “Plaintiffs”) claims that they are entitled to damages resulting from Mr. Ports’ June 27, 2002 fall on the premises of a Circle K store located in Shreveport, Louisiana.
