These three cases present the question of the proper discipline to be imposed on an attorney who places his clients’ funds in a commingled account and thereafter uses the funds. Cases One and Two were reported to the full court by a single justice in each instance. Case Three is here on the appeal of the Board of Bar Overseers (Board) and Bar Counsel from the disposition entered by the single justice. The Board and Bar Counsel recommend that there shall be a public censure in two of the cases and a six months’ suspension from the practice of law in the third case. Nevertheless,…
