Defendant, Dwight Blackmon, appeals the judgment of conviction entered on a jury verdict finding him guilty of possession of a controlled substance. We affirm the convietion and remand for re-sentencing.

According to the testimony of two police officers, while they were on patrol watching for people engaged in illegal drug activity, they saw defendant drop an object from his coat pocket. The two officers approached defendant, and while one spoke to him the other searched for, and found, the dropped object, discovering that it was a broken glass "crack pipe." That…
