This appeal is a companion case to State v. Seay, 94 Adv Sh 727, 8 Or App 509, 495 P2d 39 (1972), in which defendant’s conviction of armed robbery was affirmed. In this ease defendant appeals from conviction and sentence for possession of a narcotic drug. ORS 474.020.

In addition to the facts set forth in the former opinion the evidence in this case indicates that when the defendant was arrested for the armed robbery he stepped outside of the automobile used in the robbery and threw back into it a hypodermic syringe which was confiscated by the arresting officer and which, under laboratory…
