MEMORANDUM OF DECISION AND ORDER

Salah Anani (“Anani” or “the Plaintiff’) commenced this action on behalf of himself and other similarly situated individuals against CVS RX Services, Inc. (“CVS” or “the Defendant”) seeking unpaid overtime compensation pursuant to the Fair Labor Standards Act of 1938, 29 U.S.C. § 201 et seq. (“FLSA”) and the New York Labor Law §§ 650 et seq.
