MEMORANDUM
CAFFREY, Chief Judge.
This is a civil action brought by the plaintiff Reynolds Industries, Inc. (“Reynolds”) against the defendant Mobil Oil Corporation (“Mobil”). In Count I the plaintiff alleges that Mobil violated the Federal Emergency Petroleum Allocation Act of 1973 (EPAA), 15 U.S.C. § 751 et seq., and Mandatory Petroleum Allocation Regulations (MPAR), 10 C.F.R. Parts 210 and 211 promulgated thereunder by refusing to supply Reynolds the correct quantity of gasoline in retaliation for Reynolds’ institution of a lawsuit against Mobil.
