H. P. Hinton, plaintiff below, on trial of this cause recovered a judgment against the defendant, Eire Association of Philadelphia, for $718.24, alleged to be a loss from fire covered by a policy of insurance issued to him by that company through its agent W. F. Miller. The original suit was filed against both the insurance company and its agent, declaring on a loss under the terms of the policy. In a second amended petition the suit was abandoned as to the agent, Miller, but It was alleged that the policy by its terms and conditions as originally contemplated was intended to and did, in…
