Lottie P. Rohlf owned a judgment against Herman Struckmeyer. She garnished the claim of Herman Struckmeyer against F. C. Weidemann. This claim was the subject of a suit between Herman Struckmeyer and Weidemann and at the time of the garnishment Weidemann had died and his executor, Erwin J. Wente, had been substituted as defendant. The garnishee-executor appeared and answered oral interrogatories propounded to him by the judgment creditor’s attorney.
