O'n July 22, 1942, the last day on which a political candidate could file his petition with the Secretary of State to have his name placed on the ballot for the primary election on September 1, 1942, the petitioner Walter M. Critchlow, presented his petition to defendant secretary of State and tendered the alleged filing fee to have his name placed on the primary ballot as a candidate for nomination on the Democratic ticket for “Justice of the Supreme Court of the State of Utah for the unexpired term of Eugene E.
