Claimant 0 ’Neil presented his claim to the Industrial Accident Board for compensation for injuries alleged to have been sustained on December 15, 1934, while employed by the Federal Emergency Belief Administration (F. E. B. A.) in Billings, which at the time was operating under Plan 3 of the Workmen’s Compensation Act. After hearing before the board his claim was denied. He applied for and was granted a rehearing, after which his claim was again denied. He appealed to the district court.
