On June 20, 1933, Walter A. Best was employed as a cement finisher on certain improvements being made by the Great Western Sugar Company at its sugar factory in Billings. While in the performance of his duties, he sustained injuries as the result of an industrial accident, which was reported to his employer. The injured man filed a timely claim for compensation which, after hearing had, was denied by the Industrial Accident Board. A formal motion for a rehearing, unsupported by affidavits, was denied and the claimant appealed to the district court of Yellowstone county, where a trial was had…
