OPINION

Before BOOCHEVER, C. J., and RABI-NO WITZ, CONNOR, BURKE and MATTHEWS, JJ. CONNOR, Justice.

This dispute arose from a 1971 land sale contract and a subsequent promissory note executed by appellant James D. Milne in favor of appellee Esther Anderson.

Benjamin Walters, Sr., acting on Milne’s behalf, negotiated with Anderson to buy her Homer property — a lot with an apartment house, a small house, and a large storage structure. 1 Milne signed a contract to purchase the land, “all buildings thereon, and furnishings and fixtures, therein,” and Walters mailed it to Anderson who then resided in…
