Plaintiffs are two hospitals, Emanuel Medical Center (“Emanuel”) and Merced Community Medical Center (“Merced”) (collectively, “Plaintiffs” or “Providers”). They bring this action against Kathleen Sebelius in her official capacity as Secretary of the Department of Health and Human Services (“Defendant” or “Secretary”), pursuant to Title XVIII of the Social Security Act, 42 U.S.C. §§ 1395 et seq.
