These proceedings in the court below, were had at October term, 1853, of the Morgan Circuit Court, Woodson, Judge, presiding.

This information contains five counts. The second and third were dismissed by the State’s attorney. To the first, fourth, and fifth a several demurrer was filed, which was sustained by the circuit court, and to reverse this decision the case is brought here. The first count was bad for the want of a proper venue. It does not state in what county the offence was committed. It is as essential to an information that a proper venue be laid, as to a declaration or an indictment.
