SHAW, J.—
This is an appeal by the petitioner from a judgment of the superior court of San Diego County in favor of the respondent. The proceeding was in certiorari, to review the order of the respondent, Frank P. Frary, as mayor of the city of San Diego, removing the petitioner from the office of fire commissioner of the city. By the terms of the charter the fire commissioner is appointed by the mayor, subject to confirmation by the board of delegates, and holds office for the term of four years. (Stats. 1889, p. 720.)
