Affirming.
A demurrer having been sustained to the petition of the appellant and he having declined to plead further, the same was dismissed. This appeal results.
It appears from the petition that the appellant, the Honorable Ben Johnson, was appointed by the Honorable Ruby Laffoon, then and now Governor of this Commonwealth, road commissioner for the Fourth road d'is triet of Kentucky on February 3, 1932, for a term expiring February 1, 1936.
