This case involves a claim by Harry Clifford Langdon against the estate of his deceased wife, Mildred E. Langdon. The claim was disallowed in the probate court and allowed on appeal by the district court. The executor of the Mildred E. Langdon estate *268and the guardian ad litem for Rose Heise Walters, an insane legatee, have appealed from the judgment of the district court.

After the action was tried the claimant died and the action was revived in the name of Hugh C. Langdon, administrator of the estate of the claimant.
