The complaint was filed May 7, 1953, with the plaintiff asking for appointment of a receiver and an accounting. On March 12, 1955, judgment was entered dismissing the case with prejudice due to the failure of the plaintiff to appear and prosecute. On writ of error by plaintiff this Court ordered that the judgment of dismissal be reversed with directions to proceed with the trial of the case on its merits. Thompson v.
