FTo executor was appointed by the will of the decedent. Pending the application for the probate of' the will, the temporary *11administrator with the will annexed was appointed on the 20th day of December, 1905. The petitioner is the heir at law and next of kin of the decedent. He was.appointed administrator on the 17th day of August, 1906. The decedent left a large amount of personal estate, and two parcels of real estate situáted in the county of New York.
