ERROR TO THE OIRCDTT COURT OE THE UNITÉD STATES FOR THE DISTRICT OF NEBRASKA. This was an action in contract. Judgment for plaintiff to which defendant sued out this writ of error. The case is stated in the opinion.

1. It is suggested that the amount in dispute is less than five thousand dollars. This point is not well taken. The amount for which Bussell & Co. sued in their original petition' was §1206.07, with interest from October 9, 1888. That amount was increased by the supplemental petition to $3882.20. The plaintiffs in error, who were defendants below, denied their liability in any sum, arid, by way of counter claim, in accordance with the practice in Nebraska, asked for judg ment against Russell & Co. in the sum of $10,000.
