Plaintiff-appellant Makuc brought this suit in Federal District Court, seeking in-junctive relief and damages for injuries sustained while riding a motorbike manufactured by the defendant-appellee. The complaint included counts for breach of implied and express warranties, negligent design, manufacture and failure to warn, fraudulent concealment, misrepresentation, and violation of Mass.Gen.L. ch. 93A.
