This matter comes before the Court on Defendant Millennium Laboratories, Ine.’s (“Millennium”) Motion to Dismiss Counts I, VI, and VII of Plaintiff Ameritox, Ltd.’s (“Ameritox”) Third Amended Complaint. (Doc. No. 101). Ameritox filed a Response in Opposition (Doc. No. 118) to Millennium’s motion.
