MEMORANDUM OPINION

LEWIS A. KAPLAN, District Judge.

This action arises from an altercation between plaintiffs Jairo and Luis Rodriguez 1 and defendant Matthew Weinstein (“Weinstein”), a New York City police officer who was off duty at the time of the incident. Following the altercation, plaintiffs were arrested by New York City police officers and charged with assault and harassment, charges that ultimately were dropped.
