Plaintiff Leonard W. Beard instituted this action against Railway Express Agency, Inc., based on common law negligence, and against defendant Missouri Pacific Railroad Company under the Federal Employers’ Liability Act (45 U.S.C.A. § 51 et seq.) for personal injuries sustained when plaintiff was on duty as a carman at the Union Station at Little Rock, Arkansas. A jury returned a verdict in favor of plaintiff and against both defendants in the amount of $68,000.
