David Wickwire’s house in Hurlock, Maryland sustained major damage from a fire. His homeowner’s insurer, Cumberland Insurance Group (“Cumberland”), paid his claim, and came to believe that the fire was caused by faulty wiring in the house’s electric meter box. Cumberland seeks subrogation from Delmarva Power (“Delmarva”), Mr. Wickwire’s electric company, but the Circuit Court for Dorchester County granted Delmarva’s motion for summary judgment on the ground that Cumberland destroyed the fire scene, which deprived Delmarva of the opportunity to investigate or defend the claim.
