O’CONNELL, Circuit Judge.
Plaintiff appeals from a “judgment of nonsuit” granted at the close of the presentation of his case. Plaintiff, the sole witness to testify, asserted that he was a passenger traveling from New York to Long Branch, N. J., on a train operated by defendant, a common carrier. Reading a newspaper, he was sitting in an aisle seat in the rear of the train.1 Across the aisle were four men playing cards.
