This matter came on for hearing on the Court’s own motion as to why the chapter 11 case of ABEPP Acquisition Corp., dba Abbott & Company (the “DIP”) should not be converted to a case under chapter 7 or dismissed pursuant to § 1112(b). Upon consideration of the evidence adduced at the January 10, 1996 hearing on this matter, this Court converted the DIP’s case to a case under chapter 7 pursuant to § 1112(b), based primarily on the continuing loss to or diminution of the estate and the…
