The defendant Havelock Coal Company is the owner of a coal mine in Hettinger county. Plaintiff Walsh was its employee. His duties were those of pit boss, mining engineer, manager and superintendent; he assisted in timbering of the mine, laid out and supervised runs, and in slack times he would “go down and shoot and load cars.” During the season when mining operations were nearly at a standstill because of the unseasonableness of the product, he went out on the road to make collections and sell coal.
