MOORE, Justice.

Plaintiff first assigns as error the holding of the Court of Appeals affirming the action of the trial court in allowing defendants’ motion for a directed verdict under Rule 50 (a) as to the issue of punitive damages.

This action is based upon fraudulent representations made by Toler on behalf of himself and his principal, Pamlico Motor Company, which were relied upon by the plaintiff in purchasing the automobile in question.
