Appeal from. Polk District Court. — HoN. A. H. McYey, Judge. Action to establish and quiet plaintiff’s title to an undivided seven-tenths of an eighty-acre tract of land in Polk county, Xowa, and for a partition accordingly. . The district court denied the relief asked, and plaintiff appeals.

In the year 1864, Francis Malley and Catherine Elizabeth Malley his wife, being about to separate, united in conveying certain lands in severalty to their children Fred H. Malley (plaintiff herein), Mary Malley, William Edwin Malley, John Malley, and Paul F. • Malley, d- fend ant herein. Another child, Louisa *238Schlenker, appears to have been previously provided for.
