The information in this case charges that Hugh Russell did have in his possession two gallons and three quarts of corn whisky with intent to sell the same. Upon the trial appellant was by verdict of the jury found guilty, without assessing the punishment. Motion for new trial was duly filed. January 28, 1922, the motion was overruled, and the court sentenced appellant to confinement in the county jail for 30 days, and to pay a fine of $250 and costs. He appeals to this court for a reversal of the judgment because of the admission of incompetent evidence over his objections and insufficiency…
