In a March 28, 1996 indictment, defendant Fronk was charged with participating in a conspiracy to distribute and possess cocaine with intent to distribute in violation of 21 U.S.C. § 846, distribution and possession of cocaine with intent to distribute in violation of 21 U.S.C. § 841(a)(1) and use of a communication facility to commit a drug felony in violation of 21 U.S.C. § 843(b).
