delivered the opinion of the Court.

In this' action J. L. Eddings sued the National Life and Accident Insurance Company to recover benefits on account of sickness, under the terms of an industrial insurance policy. The policy contained a provision that the insurer assumed no obligation unless the insured was in sound health when the policy was issued, and the defense of the company was that the plaintiff had not been in sound health at that time.
