Appeal from, the District Court of Jones, on change of venue from Crosby. Tried below before Hon. J. V. Cockrell. This conviction was in the first degree for the murder of A. Beemer, the penalty of death being assessed against the appellant. The homicide occurred on the 10th day of September, 1887, at the Matador ranche, in Motley County, which county is attached to Crosby County for judicial purposes. B. F. Brock was the first witness for the State.

Appellant was convicted of murder of the first degree, his punishment being assessed at death.
Several bills of exception saved to the ruling of the court present the principal matters complained of as error.
