This is an appeal from a judgment awarding plaintiff damages for injuries sustained in an automobile collision.

The facts are, that on the evening of September 29, 1924, plaintiff was driving his Ford coupé on a straight public highway, with his lights on and keeping to the right-hand side of the road. The defendant, driving a Ford truck, without lights, entered the highway from a gate to the left of plaintiff, intending to cross the highway to a gate on the opposite side.
