MEMORANDUM AND ORDER
WAXSE, United States Magistrate Judge.
This matter is before the Court on Defendant’s Motion to Bring In Third-Party Defendant, Wal-Mart Stores, Inc. (doc. 33). For the reasons set forth below, the Court will deny the motion.
I. Background Information
On or about June 11, 2001, Mr. Melvin Willard (“Willard”) was involved in an “incident” at a Wal-Mart Store in Fort Scott, Kansas.
