R. 56, on a Motion for Summary Judgment filed by The Provident Bank, defendant third party plaintiff, and on a Motion for Partial Summary Judgment, filed by Neo-Tech Systems, Inc., plaintiff. The court has reviewed the file herein including the pleadings, affidavit, extensive memoranda of counsel and oral arguments.
